This policy explains what personal information Island Yacht Care collects through this website, our forms, WhatsApp, email and our services, why we use it, who we share it with and the choices you have.

1. Who we are

This website is operated by Island Yacht Care, Front Street 45, Philipsburg, Sint Maarten ("we", "us"). We are responsible for the personal information described here. Questions or requests: info@islandyachtcaresxm.com.

2. What we collect

• Enquiries. When you use our contact form, send a WhatsApp message, email or call us: your name, email address, phone number, details about your boat and the message you send.
• Selling a boat. When you use the For Sale forms: your name and contact details, whether you are the owner or act for the owner, details about the boat, the asking price, and any photos and documents you upload.
• Clients. When we work for you: your contact details, your boat's details, service notes, photos taken during our work, and invoice and payment records.
• Boats listed for sale. The boat details and photos that the seller has approved for publication. Seller names and contact details are never published.
• Website use. Our hosting provider records technical data such as IP address, browser type and the pages requested, to deliver the site and keep it secure. If you agree to optional cookies, Meta Pixel and Metricool record visits and interactions (see section 6).

Please do not send us sensitive information (such as health data or identity documents) unless we ask for it for a specific legal reason.

3. Why we use it

• To answer your enquiry and prepare a quote (steps you ask us to take before entering into an agreement).
• To deliver our services, keep service records and invoice you (performance of our agreement with you).
• To present your boat for sale, prepare your listing agreement and handle buyer enquiries (performance of our agreement with you).
• To keep business, tax and bookkeeping records (legal obligations).
• To protect the website, our portal and our business, for example by limiting repeated login attempts (our legitimate interests).
• To measure visits and improve our advertising, only if you accept optional cookies (your consent, which you can withdraw at any time).

We do not sell your personal information, and we do not use it for automated decisions that have legal or similarly significant effects on you.

4. Who we share it with

We share personal information only where needed for the purposes above, with:

• Service providers who process it on our behalf: Vercel (website hosting), Supabase (our database and photo storage), FormSubmit (delivers website forms to our email inbox), our email provider, and our bank and payment providers.
• Meta and Metricool, only if you accept optional cookies.
• WhatsApp (Meta), when you choose to contact us on WhatsApp. WhatsApp's own terms and privacy policy apply to that service.
• Parties to a boat sale, where needed to arrange viewings, surveys and the sale, and only as far as the seller or buyer has agreed.
• Contractors and suppliers we coordinate for your boat, limited to what they need to do the work.
• Authorities, advisers or courts where the law requires it or to establish, exercise or defend legal claims.

5. International transfers

Some of our service providers store or process data outside Sint Maarten, including in the United States and the European Union. Where we use them, we rely on their contractual and security commitments to protect your information.

6. Cookies and tracking

• Necessary. The owner portal uses a secure session cookie to keep the business owner signed in, and your browser stores your cookie choice. These are needed for the site to work and are always on.
• Optional. Meta Pixel (Meta Platforms) and Metricool help us measure visits and the results of our advertising. They load only after you click "Accept" in the cookie banner. If you decline, they are not loaded.

You can change your choice at any time with the "Cookie settings" link at the bottom of every page. The fonts on this website are stored on our own server, so loading a page does not send your data to Google.

7. How long we keep it

• Enquiries that do not lead to work: up to 2 years after our last contact.
• Client, service and invoice records: as long as we work together and afterwards for the period required by tax and bookkeeping law.
• Boat listings, photos and seller details: while the boat is listed, and afterwards as long as needed to complete the sale and handle any follow-up or claims.
• Records of failed portal logins: a short period for security, then deleted automatically.

8. Your rights

Depending on where you live, you may ask us to give you a copy of your personal information, correct it, delete it, limit or object to how we use it, or transfer it to you or someone else. Where we rely on your consent, you can withdraw it at any time. Send your request to info@islandyachtcaresxm.com; we may ask you to confirm your identity and will reply within one month. We may keep information where the law requires us to. You also have the right to complain to the data protection authority where you live or where we are based.

9. Security

We use encrypted connections (HTTPS), password-protected and rate-limited access to our owner portal, and reputable hosting providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Children

Our website and services are intended for adults. We do not knowingly collect personal information from children under 16.

11. Changes to this policy

We may update this policy from time to time. The date at the top shows when it last changed.
